On the same principle, the bad judgment of crazy old people should deny them their rights. We deny crazy old people their rights a lot- families frequently make calls on this-- They lock old people in rooms, and tie them in chairs and drug them, they take away their car keys and their checkbooks. There's a tacit acceptance of a lot of this. Old people aren't cute either. Ideally, a court hears the case of an old person to determine his ability (or in-)before appointing a guardian. Children automatically have guardians (parents)becuase they aren't ready to assume responsibility for their own lives yet. The age of 12 was something I thought I'd read, or maybe heard on the radio, but since I can't find it, it may have been someone else's opinion. But, yes, it IS my opinion that most 6 year olds are not capable of this kind of decision. (You and I have always held different ideas on this though, even if we share the ultimate goal for our children of independent thought.) Children are very easily influenced and don't have a broad enough base of experience to make decisions that affect their lives so permanently. Elian's experience of America at this point has about as much reality as a trip to Fantasyland and he has probably been coached a lot on what to say by the Miami relatives. How can he judge? I talked with someone last night who says that in Cuba a child is placed in a boarding school at the age of 8, and that we actually are sending Elian back to Castro, not his father, that there are no parental rights there. My knowledge of life in Cuba is not very great. Anyway, I don't know that it changes my view, but I'll throw it into the mishmash of my brain. As for abortion- I stay away from that argument.
