(Nasdaq: PHCM), a leading provider of software enabling delivery of Internet-based applications and services to wireless telephones, announced today that it has filed a lawsuit in the United States District Court in San Jose against Geoworks Corporation. The lawsuit alleges, and seeks a court order declaring, that U.S. Patent No. 5,327,529 (the '529 patent), assigned to Geoworks is not infringed by Phone.com and that the '529 patent is also invalid and unenforceable. As a leader in the wireless Internet industry, Phone.com took this action in response to Geoworks' aggressive attempt to require industry participants to obtain licenses under the Geoworks patent. In its complaint, Phone.com asserts that Phone.com's technology does not infringe the Geoworks '529 patent, and that the patent is also invalid and unenforceable.

Alan Black, Chief Financial Officer and Vice President of Phone.com, said, "We believe that this lawsuit will produce an unequivocal declaration that Geoworks' patent has no relation to, and is not infringed by, Phone.com's technology, and that, in addition, the patent is invalid and unenforceable."
