Again, if the action was indeed unlawful, they can surely obtain a court order requiring that the ultra vires action be undone, and Elian returned. Why haven't they?

I know what they said; I am expressing my belief that even a Court order would not have been obeyed--i.e, INS officers still would have been forced to forcibly enter the home, and forcibly remove the boy. I believe that this is a spectacle Lazaro et al. wanted and needed in order to save face with their community. You're free to believe otherwise.
