The custody matter is not relevant. The INS cannot (as I understand it) take him away from his father and give him to someone else. He should be with his parent until his status has been determined. If he were a US citizen you could go into court and do the best interests stuff- and try to sever parental rights- but he is not a citizen and thus should be with his father until status is determined. If he requested his father when he was first picked up he should have (imo) been repatriated immediately- as I doubt he made any requests for asylum and merely wanted his surviving parent.
