Certainly he is to be comfortable- and in general that means with the closest relative- now that his father is here, his father would be that person. The asylum guidelines mention children in fear for their physical safety at the hands of their parents- but that deals more with children sold or enslaved by their parents- this case is not analogous to those cases.

The asylum request is supposed to come from the child without undue influence- there is no way a court won't find pressure was applied here.
