It isn't custody that is relevat to any decision of asylum- it is FEAR of persecution. It's a totally different issue. This kid has NO fear of persecution. He'll be a hero when he returns to Cuba.

Of course that may be irrelevant if Cubans really do have special status as asylum seekers- but I hope they don't. However they do have to actually WANT to seek asylum. The ONLY issue before this INS court is DOES the boy want asylum (the BOY- not the people who want to sway the boy- on either side) and does he fit whatever guidelines there are. Those are the ONLY issues. (As I read the asylum guidelines)
