The appeals court also refused Reno's request for a change of custody. She has never claimed the uncle was mistreating the boy. She hasn't adequately explained why it was necessary to move when she did.

As I understand it, the court refused Lazaro's custody claim, and therefore temporary custody was transferred to Janet Reno by default in accordance with immigration law. I could be wrong about this.

The uncle claims to have evidence that the father called him from Cuba last October asking him to take care of his boy. If that's true does that make thing a little cut and dried for you? If it's true why did he change his mind? Is he being coerced? Has anyone asked him?

OK. The uncle deserves his day in court. Let's see if he has any evidence to support his claim. Didn't he present this evidence to the appeals court in Atlanta?

The uncle is lying? Well That's why we have courts, to try to tease out the truth. This is a custody battle. There are two sides. There are facts in dispute. What business es the Federal Executive have taking sides in a custody dispute?

Didn't the Florida family court dismiss the custody case as well? The uncle has tried in state and federal court to obtain custody, and he failed in both cases.

If it were granted to me the exclusive power to decide what do do with Elian, I honestly don't know what I'd decide. I wouldn't make an immediate knee jerk decision like Clinton/Reno. And I'd feel compelled to explain my reasons, unlike Clinton/Reno.

Huh? Isn't it the Clinton adminstration who orginally turned the boy over to his relatives in Florida? Clinton/Reno took their time and let the courts rule. In both cases the courts denied custody to the uncle. I don't see how they rushed it? A lot of people think Reno waited too long to take this action. I don't agree with that either. But, it was time to assert the rule of law and return the child to his father who had legal custody IMHO.
