How can you say that, especially in the last two years, when any yahoo (pun intended) could have put a business plan together with Velcro, and raised $600 million as mezzanine financing?

There is nothing wrong with grabbing a market. But you can do it in many ways, from killing your competitor to making a better product.

The methods that they now get convicted for will imply some kind of penalty, but nobody has said that the DOJ way of punishing is the way that the judge will decide.
