Yes, Moore was officially out of the case, as a case. It could be remanded to him if the Court of Appeals reverses his decision that Elian had the right to apply for asylum, I assume. X is reading up on the asylum process, it's adminstrative. Under the Administrative Procedure Act, the District Court is where you appeal if you aren't satisfied with an administrative decision, in general.

I got irate listening to the fisherman on Larry King when he said he hid in the closet and didn't turn the kid over to the US marshalls because he "didn't know who they were." The photographer said the crowd started shouting "they're here, they're here!" and "somehow he found himself in the house." With people being willing to evade, shade and prevaricate, confusion is inevitable.

I suppose the justification is "Clinton lied (about his sexual activities), so why can't we (lie whenever it's convenient)?"

Moore was the last judge on the case and knew what was what. Elian had filed for asylum and wasn't an illegal alien under those terms and he certainly wasn't kept hidden. Judge Moore knew that and certainly wouldn't have granted the warrant so they waited until 7:30 pm and went to the magistrate.

Since a certain haughty lawyer made such a big deal about putting me on ignore for having my own opinion, she should keep her snoot out of my posts.
