Jim, MSFT lawyers are annoyed with the whole lower court process and are anxious to get to appeals court. There are so many grounds for appeal this case could take 100 years. Perhaps they want the DOJ guys to have their moment of glory because they will destroy them later. I will never forget the DOJ news conference where they spent most of the time congratulating each other on a job well done. Cramer of TS.com infamy said "the brightest graduates of Harvard Law go to work at DOJ" What's he smoking?
