They tried to gain custody via the Florida family court system and were denied when the court ruled that it had no jurisdiction in the matter. Why do you think they were petitioning the court?

I have to admit that I'm not sure what the law states in regard to custody when a mother dies and the father survives in a divorced situation in which the mother has custody. I'm not even sure if they had joint custody of Elian. I'm pretty sure that the father gains custody by default of being the surviving parent. I have the feeling that you don't know for sure either if Juan has legal custody by default, according to the law. Is anyone here a divorce attorney?
