I will admit the analogy has outlived its usefulness, but don't forget that corporations are legal "people," too. To invoke self-defense, you must believe the threat is credible, so I'll take that as an admission that browsers make operating systems redundant. As for equal protection, they've had their day in court just like everybody is entitled to. Equal protection doesn't mean you necessarily treat everybody alike -- consider "third strike" laws. JMHO, and not a legal opinion.
