If royalties on SanDisk's CompactFlash assembly patents take shape I have anticipate there will be a "per unit" royalty on each CompactFlash card and that these royalties will be back-calculated as much as can be documented.

It is impossible to guarantee that this will ever happen and it is equally impossible to calculate the possible revenues that could be generated by such a successful patent defense.

Lexar Media (and, I believe, by association Mitsubishi) have to prove in U.S. Patent Court that the SanDisk '987 CompactFlash assembly patent is invalid. Patent invalidation places the burden of proof on the plaintiff who is challenging the patent holder. In this case it is a weak, unprofitable company composed primarily of ex-SanDisk employees who have already been handed a partial summary judgement against them in a related infringement suit a few weeks ago. I understand that portions of this encompassing patent date back to the early 90's or late 80's. Also, established flash card manufacturers have already agreed to pay CF assembly royalties to SNDK, most notably SSTI.

I have taken a chance by investing and not waiting for the patent invalidation suit to be heard. This in the face of a $50.00/share haircut that followed the announcement of the patent infringement victory for SanDisk.
