There is no balancing at this time. The law is the law- and there is no balancing involved- it is only the ALJ's perception of the mental state and desires of the boy that are the issue. Balancing would only be relevant if the boy were a citizen and under our legal system. Then you would have family court balance the interests of the child for custody.
