Ted,

OT

The mother illegally removed the child from Cuba

Didn't half of the US immigrants get here this way? For example, I illegally removed myself from communist Czechoslovakia.

Ted. .<<<<No, I haven't but two of my friends have. In the first case one friend was awarded full custody of their two small children due to his wife alcohol problem. In the second case my friend was awarded equal custody of their small daughter where all responsibilities and stays are 50/50. In certain states I think the courts are beginning to recognize that mothers may not be automatically the best parent.>>>>><<<<

Ted' I do not know what state you are from; but here in Wis. when I was divorced 25 yrs ago, the courts presumed the mother was a better parent period. Unless the mother had one hell of a problem; the father lost primary physical custody. And when you lost primary physical custody you also lost 17-30% of your earnings before taxes; plus any meaning ful input into your children's lives. Sure, they give you joint legal custody, but thats not the same as joint physical custody. So; does your friend have joint legal or joint physical custody? Secondly, how many friends do you have that are divorced, and what percentage got primary physical custody even if mother didn't have a problem and wanted primary custody. None? I thought so. In this state, they grant joint physical custody only if both parties agree to it. So if mother wants primary physical custody, she will likely get it. Joint legal custody sounds nice, but as a father you have very few rights; so in the end you just shut up and pay.

As far as Elian goes, what has Lasaro done illegal, except go to court to assert his rights? If you feel as I do that the court system is a mess; then fix the system; not just proclaim father's rights in one case; but make it so in all divorce cases. How many fathers in this country get any type of help just getting visitation rights. Where is Reno then? Unless you mountains of cash and time, you get nothing; except the right to pay for everything; and getting blamed for disrupting the childrens lives.
