Ok, chalu, you're the expert on constitutional law here.

So, help me out with understanding the legalities of what's going on:

The Miami family was given "temporary custody" of Elian, and then it was withdrawn when Castro made it an issue and sent Juan to DC. Elian was initially granted resident status by the INS as a Cuban refugee, but then THAT was also withdrawn for the same reason. In the meantime, a judge decided that the kid's application for residency had standing, and with legal advice, the family didn't turn him over to the INS.

Then, the gov't snatched the kid. I'm in no position to debate the value of the warrant the INS used, but it seems clear from the comments I've heard here that the Miami family must have been breaking the law, and thus the SWAT grab was warranted.

So, my question: why weren't (or aren't) the family members arrested for their illegal actions?
