Actually it was Gates' decision. He declined to settle.

Given what we've seen from this case recently, settling just might just have been worse than breakup for MSFT. It really bugged me when the judge presumed to suggest a "better" price for the Windows OS.

Let's not forget that the MSFT/DOJ saga is FAR from over. Even taking as a given that the judge will follow the DOJ's recommendation slavishly, there's still an appeals process to go through which will probably drag on another year or two. This coming election may do more than anything else to determine the fate of Mister Softee.
