Harvey, exactly my point. They should have. They have made mistakes.

Now, Boies may have an agenda of his own and maybe they tried but couldn't hire him. We don't know for sure, do we ?

Why did they not hire Boises? 1. I believe they hired the same firm that represented Kodak in an earlier successful appellate victory (represented by lead defense counsel Warren) in a case very much related to this one.
2. Same firm that represented Microsoft in earlier appellate victory over the DOJ -lead attorney was Richard Urowsky was hated by Judge Jackson.

It is widely know, that these guys do their best work in the appellate area.
