Absolutely. The "boy belongs with his father" is meaningless. The boy belongs with whoever the Cuban custody system says he belongs with- after it is determined whether or not the boy wishes asylum.

For the period while his conditional status is revoked the INS has absolute discretion in how to detain him- as he is an illegal. That's why it is always best to be legal- one doesn't have anywhere NEAR the same protections as an illegal alien. Now one could argue that illegal aliens SHOULD have the same protections as legal aliens or citizens- but that is an extremely complicated issue. Are you arguing that all illegal aliens should have the same protections as legal aliens and citizens? Are you arguing that the INS should not have control over illegal aliens? What exactly are you arguing for? (In terms of policy)
