technically, he can't be illegal because we won't let him leave. Now that would be a catch-22.

A Cuban can most certainly be illegal- the preferential treatment comes because most illegal Cubans are "paroled" for 1 year- at which time they can become legal- but they are NOT legal aliens when they arrive here- see below:

WHAT FORM OF FAVORITISM
Since 1966 the United States has accorded a unique status to Cubans in the United States illegally. By Public Law 89-732 (the
Cuban Adjustment Act), Cubans who have resided in the United States for one year -- regardless of how they entered the
country -- may convert[until they convert they are either illegal or "paroled"- as in paroled criminals ] to permanent legal residence status.
