Elian "lost"? Did he "lose" if he gets what he wants- whatever that is? Perhaps what you mean is the part of Miami exile community that wanted Elian to stay in this country lost. Let's be clear.

Which laws "rule" in this case is still up for grabs. That's what lawsuits are for. The Cuban exiles (not Elian, I don't accept that they speak for him) lost in the court of public opinion in part because of their refusal to acknowledge the validity of any criticism of their methods or their objectives. That's what the Max Castro article was pointing out.
