I"m not sure I understand what you are saying in your first sentence? Are you saying that he DOESN"T have RIghts under our laws?
I was saying only that we know nothing about what happened to Juan during those four months to prevent him (or not) from coming here. LIke Bill, I find it odd, but don't believe it is relevant. Lots of things parents do strike me odd, but I can't terminate their rights for that reason.

On Nov 29, he notified us that he considered Elian kidnapped and wanted his return. In Dec, officials met with Juan and verified his claim as father of Elian.

The issue of force is completely unrelated to the custody issue, isn't it?? If you are starting a new topic, I think it's important to differentiate between USE of force and SHOW of force. Given the threats of human chains made by the protesters, the inflammatory attitude of the mayor, the comments of the uncle that he would NOT turn over Elian-- I think it would be remiss of the agents NOT to be prepared.

I do question how much damage was done to the house. The door frame in the bedroom looks fine in the pictures. ANd the comment that a statue of the Virgin Mary "lay on its side"
Well- that seems- trivial- in terms of FORCE..

I would say he has his parental rights in tact. It certainly appears that Cuba feels that way and unfortunately for your argument that's what counts.

5. Elian's natural father, Juan Miguel Gonzalez, contacted the Cuban Foreign Ministry and requested the return of his son Elian. Officials of the INS and the State Department interviewed Juan Miguel Gonzalez on December 13 and 31, 1999, in Cuba, to evaluate his claim that he was Elian's father and wanted his son returned. On January 5, 2000, the INS Commissioner Doris Meissner determined that Juan Miguel Gonzalez was Elian's biological father and has legal custody of Elian under Cuban Law. Exhibit B. Accordingly, Juan Miguel Gonzalez had the right and obligation to represent Elian in all legal transactions and acts in which Elian has an interest. Juan Miguel Gonzalez advised the INS that he did not want Elian to seek political asylum in the United States, and requested Elian's immediate return to Cuba.
