I read a passage a long time ago, that went something like this "a Mountain needs no reason to stand, a river no reason to run, but men are creatures of motivation. And a just man and an unjust man can arrive in the same country, but we will know them by the path they took to get there." I am sure I am getting the words mixed up- but the meaning I took away was that how you arrive at your solution and who you are willing to hurt, in the smaller and greater scheme of things, is what is important.

Do the least harm to the smallest number of people.

There are many possible solutions to this Elian matter- beginning I think, with what the boy wants. If he wants to go home with his father and live in Cuba who is hurt? Is the boy hurt because he is choosing to live with his father? Is the father hurt, because he is getting to live where he says he wants to live? Is the Cuban community hurt because one family of Cubans does not want to join them? Is the US hurt because Juan chooses not to live here?

Any ALJ who hears this case will listen to Elian. That Elian's love for his father should influence his decision is a given- and why shouldn't love influence him?

Freedom given to people who are then told they cannot make the choice to choose to live under tyranny is not freedom. That is simply dictatorship masquerading as freedom. It is wonderful that freedom can encompass tyranny, and that tyranny cannot encompass freedom. It is dangerous but also wonderful. In a free society you can give your life over to a cult. You can choose to move to a dictatorship (but you may not be able to move back). I personally would not make those choices. I LOVE my freedom. I relish being able to think whatever I want and do almost anything I want. But I wouldn't become a dictator in order to force MY pleasures on anyone else.

There is a lot of talk about what is BEST for the boy. But really, in a free country, he and his father should be able to choose for themselves even IF the decision is not "best" for the boy in the opinion of others. Although how on earth you figure out what "best" is on this planet is beyond me.
