I think the real issue is selective disclosure. When one is trying to make news and discloses that news to others who act on that supposed news before the disclosure, this may be a violation of the anti-manipulation regulations under the SEC acts.

The nature of being a public investigator means that the public is subject to the good faith equal disclosure by that investigator.

When others use that selective knowledge to "create volume" then the whole group may be manipulative as that term is interpreted under the code and regulations previously referenced.

The issue of whether an investigator becomes an "investment adviser" under the code and regulations is also another very interesting area.

The internet is making new cases with new theories. I would be very careful in bashing. Make sure of the facts and don't selectively disclose them.
