If your order hit at the close the MM might have some wiggle room, it would pay to check on the exact time that your order was entered. For some info on the Manning Rule you can check this link;

Not obligated to fill the rest?!?!?!? I think you have a great argument to make on that LAME excuse. Number one...if your broker is selling his order flow to NITE, then NITE is REQUIRED to fill your MARKET order IMMEDIATELY or send it to an ECN IMMEDIATELY for an IMMEDIATE fill at the best price possible. It takes all of 5 seconds for that to happen and there is NO excuse. You have a valid case as long as the order was a MARKET order. They must fill it without delay. The key fact is that if NITE does not want to fill you more than 200 shares out of pocket, then NITE must go out to the market and let you be filled instantly...often through an ECN.
