His conclusions are the same as those of Donato Dalrymple, one of the fishermen who saved Elian from the sea and who has taken the extraordinary step of petitioning the court to appoint a lawyer to represent Elian's interest. As Donato and other legal experts have pointed out, Miami lawyer Kendall Coffey is simply masquerading as Elian's attorney. Coffey has too many conflicts of interest - including the fact he has been a close associate of Janet Reno's for more than a decade - to act impartially on Elian's behalf. Dershowitz told Geraldo on Thursday night, "But the person who was absent in this courtroom - and this is very important - was Elian or any lawyer representing Elian. Everybody else in that courtroom had another interest. They had an interest in representing the U.S. government, in representing Castro, in being opposed to Castro, the National Council of Churches ... There was nobody there saying, 'Look, I am unconflicted, I have read ... I have looked at everything; I have spoken to Elian ... I'm here to tell you what he himself wants and why he signed the initial application and why he withdrew the application ...' The absence of Elian's lawyer is a critical omission in this case." Twenty-four hours after this reporter and Donato Dalrymple appeared on the Fox News Channel's The Edge with Paula Zahn to explain why Elian Gonzalez needs his own attorney, Dershowitz also appeared on the same program saying precisely the same thing. DERSHOWITZ: "You know, Paula, the hearing room in the 11th Circuit Court of Appeals was missing someone today. The most important person of all wasn't there. There was no attorney there speaking on behalf of the boy who may want to seek asylum in this country. How can any lawyer who has an agenda speak credibly for the boy? What he needs is his own lawyer appointed by the court who can put forth his interests unencumbered by any agenda other than the boy's welfare." FROM DONATO'S BRIEF: "Should the court agree with me that the boy needs his own attorney, an attorney who will present to the court the boy's positions in their fullness ... then I would ask the court to order that he have his own counsel before any other proceedings on this matter."
