Yes, if you change the example, then the hypothetical situation would be different. That's why one has to make a set of assumptions to create an hypothetical. The point of my hypothetical was to explain why 'serial hypothecation' is impossible.

Yes, if some folks decide to not follow the rules, then things are different. What's the point of worrying about all this behind the scenes nonsense? If you really believe that there are other than simple market forces driving the price of your stock you really should get out of the market, or at least put your money under the management of someone who you think is 'in the know' wrt any ongoing conspiracies.
