Yes, it is unfortunate that is is 6, and not 8 or 10.

However, I still feel it should be his choice. And he must be fully-informed by the court, whether he has the capacity to understand or not.

It is really not that hard to understand. He must be told that he can stay with his father, who will take him back to Cuba, or he can stay with his relatives, and he will stay here.

Not that difficult to get across.

And then let him choose.

I agree it is a tough thing for a 6 year old. But he is, obviously, a tough boy. He can decide.

The sad thing on both sides is the notion that a child has no rights - is a possession to have his chosing done for him.

#reply-13704850 - X the unknown would agree with you, but would qualify that to say nobody has the capacity to make an informed decision. 6 year old or 60 year old.

"these mysterious statements are so incomprehensible, they defy interpretation" and if you don't agree us we will kick down your door and point a machine gun in your face.

To continue on the "he's just 6 years old" theme...just last month, a 6 year old boy took a gun to school and shot his classmate dead - did he get charged with murder? No - they are not charging him with anything because he is just 6 years old! If the age argument is true in one case - is it not true here?

I made my mind up about Elian on Day 1 of all of this: Elian is a 6 year old who is being exploited by all those around him in Miami, Washington and Cuba. He belongs with his father. Whereever/however his father wants to raise him - I say God bless!
