The kid is obviously innocent when it comes to running around in the nude. He tried to stop the bus by chasing after it, not throwing a rock at the bus driver.

I see your point Bruce, but it does not advance your argument about Elian not understanding what he was signing. I have seen adult immigrants that don't understand what they are signing, should we send them back to the sharks?
