When your mother gave you the choice, she was delegating to you the authority to make that choice. She had the authority to do that. When you say "each should ask" and each should act accordingly, you're not giving Elian any real say. Unless the "system" chooses one someone to ask Elian and report his answer, it is conveying no authority to Elian. It's a sham. He's being lead to think he has a say when he doesn't. I think that could be worse for him than not asking him at all. Now if his father were to ask Elian just because his father loves him and would like to know what his son thinks, I think that would be a nice gesture, but it wouldn't affect the outcome and Elian would need to understand that.
