That is interesting. Generally, speech in furtherance of a conspiracy is not protected, so the qualification that one be abetting the manufacture for distribution of a controlled substance might be telling. On the other hand, if one is not actively involved in the particular criminal cabal, but merely disseminating information that might be used in such a manner, that is protected. The language of the legislation seems to give too much discretion to the prosecutor..........
