Here is a another Icahn deal in the making.

biz.yahoo.com

Nabisco was under $10 a share until late in March. It appears Icahn bought shares on the open market for much of his ownership and is now making a tender offer to gain more shares at $22 per share.

We recently saw approval from the SEC for Carl Icahn to purchase more than $15 million or 15 million shares for other than investment purposes. I think the SEC said it would not be a conflict of interest. This action did not tell us he actually purchased shares but he may have purchased up to $15 million without SEC approval. Do I have this correct?

Regards,
Mark
