It appears from the Government position that the Attorney General has some latitude in determining the efficacy of a hearing. Since an asylum hearing is necessarily about the grant of asylum, I don't think the finders of fact as you call them will be able to render any decision on his custody. I think if these finders of fact stray into the area of custody we will be off to the races as far as there being appeals and reversals.

If his father has indicated his intention to return to Cuba that makes things kind of moot and a waste of time.

Wrong AJ.

The judges are not seeking truth here.They are seeking to guide the nation and it's system of law through unchartered waters under un-precedented circumstances.There is no truth nor lie to it...just a logical and methodical process of weighing all the facts and circumstances to arrive at a destination that justifies its beginning,without political interference,hopefully.Common sense and family values should prevail over politics.

Why not let the judges decide whether a child of this age can appropriately petition for asylum under the auspices of an adult who is not the parent, and who contravenes parental desires?- that is what is being decided. It is the first question. It is being heard by judges. If they decide that children of this age cannot do this- then the issue has been heard.
