If you want the government to deny someone their rights as a parent then you are denying someone a right. If you DON'T want the government to interfere with Juan's relationship with his son, or with Cuba's relationship with it's son- then I have misunderstood you. But I thought you wanted Elian to be able to petition for asylum even though he has a guardian (the Cuban state or his father- whichever you like) that does not wish this. I thought you would force this issue. And force Juan to go through an asylum hearing even though he does not wish asylum for his son. I will be very happy if I have misunderstood you on this and you would NOT have the machinery of the state force this on Juan (not that it will).

I am so glad you do not wish to deny Juan the right to go live with his son in Cuba, right now if he wanted to. Bravo for you.
