I assume you are talking about the "pooling" of interests, that is suppose to happen between like-sized mergers, and instead, (for Cisco) happens when they merge with a 200 employee acquisition? Or is it something else?

If it is the pooling, why would the SEC or DOJ bust them for something that they've openly admitted? I have heard that most people in the financial community think this loophole should be closed, and I assume Cisco will follow the rules when/if it is. Do you know if NT is going to use Pooling for it's purchase of Xros, or is it already illegal in Canada?

And what examples of fraud or anti-competitive behavour do you mean? They certainly control a huge amount of the enterprise router space, but except for the illegal strong arm tactics of a couple of ex-Cisco employee's, I haven't heard of anything else that would be considered "fraud" or "anti-competitive". Certainly, owning such a large share of the enterprise market is somewhat self perpetuating. And I think I've read customer service has something to do with it. Where should I be looking?
