Well, IANAL, so this is just my opinion.

My take on things - there is one post on Slashdot that reproduces the MS document in its entirety. The document is copyrighted, and that post is a copyright violation.

The letter from the Microsoft attorney is overly broad. It cites the post that reproduces the document in its entirety. It also cites post that link to the document, posts that quote sections of the document, and posts that discuss using WinZip to read the document.

One thing that DMCA makes illegal is publishing decrypting instructions for copyrighted information. If a piece of copyrighted information is encrypted it is illegal to crack the encryption code. MS claims that their document is encrypted. However, all they did was Zip it. Their claim is stating that the encryption consists merely of zipping is illegal. That's extreme. Here's a post from InfoWorld that discusses the controversy.

According to the MS claim, that article is illegal under DMCA, (as is my post here, because I say WinZip).

Also, as SunSpot points out, the code is only protected with a click through license, which are not valid in Europe, so if the code was downloaded by someone in Europe and posted there, that is legal.

That's my take on it, but the whole thing is probably moot anyway. The Kerberos spec is being rewritten, and the current MS implementation will not be compliant.
