I have much sympathy for your argument, X?, but I think that it could be argued that one feature of free markets is litigation, and fear of litigation has been a more successful inspiration for good corporate practice than government regulation. The counter-argument, I suppose, is that regulations make litigation a more frightening thing: if you've killed babies with poisonous chemicals that are also illegal, the hyenas (lawyers) will feast on your dismembered corpse.
