I do not have a clear view of what's happening with the legislation between INCY and Affymetrix, regarding the "genchips". INCY was trying to build its own "genchip" business using a competing technology to Affymetrix. However, Affymetrix won a lawsuit against INCY,claiming more or less that its patent covers the"genchip" idea itself and not only a particular method of implementation. There is actually a pretty comprehensive article in the "Wired" magazine regarding Affymetrix and the "genchip" business. the legal situation is incredible complicated but its hard to believe that AFFY can extend the reach of their patents so far, that they can lock in the whole business. In any case, I do not think it matters too much for INCY since this business was still quite small and its just one of the "shovels" they will sell. Furthermore,I think they will find another way to get access to this business anyways.
