I think the JDSU/ETEK deal is close to a sure thing. My reasoning is that the DOJ is giving a hard time to companies like WCOM and possibly even AOL/Time Warner. These companies own the pipes and that is what concerns the DOJ.
JDSU/ETEK are suppliers of components. If they raise prices, NT or Lucent will go elsewhere--Corning Or increase their in house production to reduce reliance on outsourcing.

The biggest factor in getting an approval may just be the DOJ's short term track record against big deals (and big companies like MSFT). They may appear to be too much of anti-business force if they object to this deal. If consumers are to benefit, it will be hard to justify an opposition to this deal. If WCOM had received approval, it would have increased the odds against JDSU/ETEK going through. After all, they want to appear to be pro-consumer.
It could turn out to be that simple.<g>

Lets see your reaction when the bear takes the bull by the balls. Rates will continue to rise over 7% and of course consumers will blindly spend needlessly. Companies will start to announce missed earnings, slower growth, and smaller revenues more and more now. Its payback time baby. 1994 revisited.
