I don't think they want to rewrite a new 3 way split proposal. All I have read says that they are asked to make minor changes to their 2 way split. It would be hard to get a consensus among so many parties to agree to it in such a short time. Remember that the DOJ/States are not supposed to be anti-MSFT and they want to avoid being labelled as such.

I find it unbelievable how this judge wants to push this through without much of a hearing. I don't think even the DOJ feels too comfortable with Jackson's comments of today. Like I stated earlier, Jackson is basically showing much power he possesses. It appears to be an ego trip. That is why the DOJ probably will not want to change it too much. They realize it could hurt their case in appeals too much-----if it obvious to those judges that Jackon was clearly biased from his comments--and urging the DOJ to get tougher.
