Unless Microsoft raises alleged bias by the judge during the trial (for instance, by a motion for recusal), I doubt they can raise it on appeal.

But that's JMHO, and not a legal opinion.

1. Maybe the appeals court will review MSFT video testimony and realize as JJ did that they tried to manipulate the evidence and the DOJ caught them.
2. Maybe the appeals court will review Mr. Gates deposition and come to the conclusion he was evading questions.
3. Maybe the appeals court will review MSFT's management comments/actions/attitude during the trial and realize that they cannot be trusted to work within the rules of a lesser remedy other than an breakup.
4. Maybe the appeals court will realize, in a all to human way, that MSFT is a bully company with egomaniacs running abound. MSFT should of and could of settled this issue with business practice remedies. But no, they are on a mission to prove that they are bigger than the U.S. judicial system. Balmer, "MSFT will not be broken up". Says who? "We will win on appeal". 50/50. Anyone that says otherwise is foolish.
5. Go goes around comes around. MSFT is getting a dose of their own medicine from someone more powerful than them; the U.S. Govt.
6. As a past 5 year holder of MSFT stock, I am shocked and amazed at the managements reckless abandon for their shareholders.
