Agreed. I think microsoft realized that they were not going to get favorable rulings about the time that the judge appointed Lawrence Lessig as his special master. From that time on they were simply trying to introduce as much favorable evidence into the trial record as they could for eventual appeal. I don't think they purposely tried to annoy the judge; but didn't worry whether or not they did when they wanted to present something to get it on record. They screwed up with the edited demo tape and Bill Gates made the mistake of thinking that he could be as slick as Bill Clinton in a deposition. Bill Gates is as slick a businessman as you will ever see, unfortunately he didn't realize that being a slick witness in a legal proceeding requires an entirely different set of insights that few people without a legal education possess.

Jacob: I agree that it's not either and I don't think it was genuinely part of their strategy. What else can one expect from a TWX/AOL/NSCP piece. The impression I have is that TPJ was angered when Microsoft stepped into the courtroom on day one with this ludicrous notion of trying to defend itself in the Court of Law and perhaps long before. How arrogant of them.
