No, since no action at all is the preferred one for Microsoft. And a long delay until any action is imposed is also helpful.

But having a decision to break Microsoft into 2 parts be what is appealed is in Microsoft's favor. Such a decision sounds very drastic and so is more likely to be overturned. If it were overturned it would be more difficult to restart the proceedings to determine a set of behavior modifications to mandate. If the decision to split weren't overturned it wouldn't make much of a difference to Microsoft anyway.
