This week may be the best point to get into MSFT stock for several reasons:

#1. Windows 2000 is strong and corporate upgrade cycle is beginning.
#2. The case is moving out of TPJ's hands by this week and will be in friendlier turf of appeals court
#3. MSFT may start buybacks soon.
#4. The focus of wall street will likely shift to business fundamentals once case is in appeals court.
#5. Intel, DELL, Compaq, HP and IBM are saying business is very sound and see strong second half. Also all of them indicated strong Windows2000 business.

I am going more long this week.

Ever have a traffic ticket?

You go to court to try and beat it. Even if you have strong evidence in your favor, the Judge is likely to treat you rather harshly and with skepticism. Why?

1) How dare you question one of my officers of the law!? You better have a damned good excuse!

2) How dare you waste my time and the time of this court on an issue that has already been rendered. You better have a damned good excuse!

3) In this democracy, you are innocent until proven guilty. You've already been proven guilty. So you better have a damned good excuse!

MSFT had better have a damned good excuse for trying to waste another two years of the court on a dead issue.
