The tapes can't be used against Tripp basically because of her Federal immunity agreement. Also, Monica was seen as an unbelievable witness and her testimony was essentially disallowed. The Dem's political prosecution of Tripp failed because it was left w/o any witnesses.

Actually, the key ruling was that Lewinsky couldn't testify that she wasn't aware of the taping because she is a proven liar, of poor character and therefor a tainted witness. How did Linda Tripp get around that one.????
