Right the spikes don't go through the ties. I was thinking of a rock picked up in a crack in a tie but that's not big enough.

S shaped. Two theories. 1. The spike wasn't over the hole in the flange when the driver pounded it down. 2. It was a pulled spike that got a second bend from being run over by the tie setter or a train.
