The 11th Circuit has ruled in the Gonzalez case. The INS did not abuse its discretion in failing to grant an asylum hearing. Will allow the Plaintiffs 14 days to file for a rehearing en banc. The decision turned on separation of powers. Big surprise, right?

This is an interesting perspective, although I don't necessarily "buy" the Darwinian cast.

However, using your framework, if I do not actively campaign against an idea and attempt to kill it, then I make it more likely that the idea can find a home in others, no?
