01-Jun-00 10:26:07 Shares of Microsoft are bouncing higher this morning after the company filed its expected rebuttal to the government?s break- up plan. The filing included a request for an additional 12 months and a request for more precise definitions regarding the term ?Internet browser,? and operating systems. Microsoft is now preparing for the appeals process, which analysts expect to be lengthy. However, analysts expect that Judge Thomas Penfield Jackson?s decision to end the trial now will be a benefit for Mister Softy?s appeal. This morning, brokerage firms posted upbeat research notes, giving expectations for a recovery in the stock?s price, following Judge Jackson?s final ruling. The nearing closure of the trial has lifted some of the downward pressure on shares, allowing MSFT has to trend higher today. The stock has climbed $2 11/16 to $65 1/4 on heightened volume. More than 15 million shares have traded, nearly half the 10-day average daily volume, making MSFT the most-active issue on the NASDAQ. The institutional presence is strong, with 30% of total volume related to block trades. Much of the volume likely is related to speculative traders, which could lead to increased volatility in the near-term. MSFT is the most-active stock in the I-Watch pre-trade market as long- term growth-oriented investors back the stock?s rise. Notably, brokers are lifting their bids, with the stock?s rise. Despite the widespread support, some institutional holders are using today?s bounce as an opportunity to unload more stock. While the supply has not offset today?s rise, the overhang will offer some resistance.

Why doesn't Reno call ORCL's Larry Ellison Rober Baron? He is the richest man worth 50+ Billions. ORCL killed Informix and Sybase using all sorts of heavy hand Ask Jim White or Mark Hoffman.

If govts arguments were true then CSCO (90% share in high end routers), INTC (90% share in CPUs, almost 100% in 64-bit with Itanium), AOL (80% ISP); ORCL (dominant in Unix db market)should all be broken up.

Arguments of break-up won't hold water.

TPJ, Govt I think are in a tight spot. They can (a) Ask solicitor general to bypass appeals court and go directly to supreme court. If solicitor general rejects to hear before appeals court, they already have antogonized the appeals court and will find it very hard. (b) Try to go through appeals process and not try to bypass. This is also a gamble as appeals court has the view that MSFT is expressing. In either case, the case was supposed to be about tying Internet explorer to WIndows98, which the appeals court already approved and ruled in favor of MSFT.
