Eventually, the case against Wen Ho Lee will probably be dropped. I think his actual transfer of sensitive information was very minor if anything. There is a lot of controversy over how badly his case was botched:

SPY-CATCHING POST PLAN DROPPED; RENO STRONGLY OBJECTED

NEW YORK TIMES sleuth James Risen is reporting Friday that the Clinton administration has decided to drop its plan to create the position of "national counterintelligence executive," mostly due to the strong objections of Janet Reno.

Risen writes that the plan was devised to deal with widespread criticism over the way the Clinton administration has dealt with espionage -- most notably the mishandling of the case of Los Alamos nuke scientist Wen Ho Lee.

Supporting the plan were CIA director George Tenet, former deputy defense secretary John Hamre and FBI director Louis Freeh.

But Risen reveals that Reno's objections may stem from her ongoing feud with Freeh.

"[S]ome officials said they believed her opposition was the product of her ongoing feud with Freeh, whose agency is charged with overseeing domestic counterintelligence."

Risen also writes of opposition to the plan -- called CI-21 -- at Freeh's FBI "where some senior officials were said to fear that it would erode the bureau's authority over spy-hunting operations."
