under the proposed law, they can claim bankruptcy now, but if they have assets, they can move to Florida, Texas, Iowa, South Dakota or Kansas and buy a house and live in it two years and then file a bankruptcy petition and the house is exempt. under current law, they don't have to wait two years. in either case, there could be a question of whether there is a fraudulent conveyance
